Cuarto Aniversario del Blog de marinos para marinos

Este lunes cumplimos cuatro años de que se creo este blog para marinos con la finalidad de servir como una herramienta para tener acceso a lo relacionado con el ámbito marítimo y portuario.

Durante este tiempo este blog ha servido para muchas cosas algunas buenas otras no tanto según el punto de vista de quien lo vea. Y a partir de esto se ha creado mucha polémica acerca de temas que ya sabíamos que existían pero no se ventilaban de manera pública, cosa que a muchos les molesta, debido a la intolerancia que existe en nuestra sociedad. Para muchos seria mejor lavar la ropa sucia en casa, pero ese es otro problema que no se ha discutido, (lavado) trabajado y continuado ninguna actividad sobre el medio marítimo. Continúa y continuará la división de los marinos por simples motivos de intereses personales y no grupales.

Ya que esta polarizado y radicalizado el ambiente, por ejemplo existen dos frentes, el unidos de marinos mercantes y el frente unido del silencio común, ambos con sus razones y argumentos, aparte existen otros grupos, los de marinos activos y los de jubilados, que en su mayoría controlan los colegios de marinos. Existe el de marinos en funciones de servidores públicos y sus amigos, y el de los que laboran en la iniciativa privada "criticando". Y a partir de estos ejemplos, todo el radicalismo que se observa.

Durante mucho tiempo se ha buscado que un marino mercante sea el director general, y ahora que se tiene sabemos que no necesitamos que en dicha posición este un marino, porque vemos que para como estamos ó seguimos con un licenciado nos basta. Igual pasa en la educación náutica, tenemos todo el sistema lleno de marinos y ningún pretexto para resolver la problemática que se incrementa conforme pasa el tiempo. También tenemos un marinos en la presidencia de la comisión de marina del senado, e igual los pendientes siguen. Cada ves se crean más asociaciones o grupos de marinos con las mejores intenciones.

Entonces, ¿que nos falta para poder dar un buen rumbo a nuestra marina?.

En esta sociedad es un crimen tener conciencia social, de ahí el desacuerdo de muchos con este blog, pero como esta hecho para todos los marinos, si existe alguien que no este de acuerdo, o no le guste porque existe una ventana para comentarios, cuanto lo sentimos, bienvenidos a una sociedad abierta y democrática, donde como dijo Octavio Paz, los mexicanos debemos de autocriticarnos para poder madurar y crecer.

Que existen empresas que no les gusta que su nombre aparezca y se les mencione según la experiencia de quien comenta, sería bueno que esas empresas hicieran un examen de conciencia para ver si su actuación ante las personas que tienen necesidad de laborar para tener un sustento es el más correcto, si sus salarios y prestaciones son las adecuadas.

Desde que apareció este blog que no es el primero, único y ultimo, ha servido para que más compañeros tengan la iniciativa de crear otras ventanas para los marinos, se ha creído que en cuanto se abra los marinos se desbocaran participando y se llevan una sorpresa, porque la participación efectiva es poca ó casi nula, no se puede saber si por apatía o por miedo.

Esperamos poder seguir por más tiempo colaborando con la comunidad, y que el blog siga siendo una ventana para tenerla como termómetro de la situación fuera del alcance de nuestros ojos y sentidos.

Así mismo son y serán siempre bienvenidas las críticas a la labor realizada en el blog, ya que esto ayudara a mejorarlo e incrementar el interés por los marinos.

Marinos envían al país 300 millones en divisas

TEGUCIGALPA.- Autoridades de la Dirección General de Marina Mercante, definen una estrategia que permita duplicar el envío de unos 300 millones de dólares al año en divisas de parte de unos 25,000 marinos hondureños empleados en buques.

Estadísticas proporcionadas en la Secretaría de Trabajo, establecen que desde 1997 a 2009 se han embarcado alrededor de 43,000 marinos hondureños.

La Escuela Marítima Centroamericana revela por su parte que desde 1999 hasta junio de 2010, se han graduado 67,124 hondureños que aspiran a un empleo en un buque.

Asimismo, la Comisión Económica para América Latina y El Caribe (Cepal), en un informe del 2001, ubicaba a Honduras en el primer lugar, respecto al número de marinos a nivel de Latinoamérica, con 19,580 embarcados.

“Tenemos 25,000 marinos embarcados y cada uno envía 1,000 dólares mensuales a su familia, Honduras percibe unos 300 millones de dólares anuales”, expuso el director general de Marina Mercante, Willy Mejía.

“Hemos descubierto el gran potencial de empleo marítimo, nuestro país carece de mucho empleo y a la vez las divisas que manda los marinos pasan en el anonimato”.

“Queremos desarrollar un plan estratégico y la tecnología en el campo de la Escuela Marítima Centroamericana para duplicar las cifras”.

“Duplicar ese monto es un proceso que llevará tiempo, pero hay que empezar, si tenemos un número de embarcados sin mucho esfuerzo y hacemos lo que corresponde, aumentaremos el número”.

Ampliación de turno al proyecto de decreto que reforma diversas disposiciones de la LNCM

EL 22 DE OCTUBRE CIERRAN LAS

Panamá, 18 de octubre de 2010. La Universidad Marítima Internacional de Panamá (UMIP), informa a los interesados en estudiar una carrera marítima, que el próximo viernes 22 de octubre cierran las inscripciones en esta casa de estudios, constituyéndose en la última oportunidad para aquellos que desean inscribirse para el Período Académico 2011.

El pasado 17 de septiembre la UMIP extendió el Periodo de Inscripción con el objetivo de abrir el abanico de oportunidades y permitir que aquellos estudiantes interesados que por diferentes razones no se pudieron inscribir lo puedan hacer en horario diurno o nocturno.

El costo del proceso de inscripción es de B/. 45.00. Al inscribirse aspirante recibirá un temario para Prueba de Evaluación de Conocimientos Generales en un CD, que se realizará el 30 de octubre próximo.



La UMIP les recuerda que para ingresar a esta casa de estudios los aspirantes deben pasar por pruebas de admisión que incluyen una Prueba de Evaluación de Conocimientos Generales, otra prueba de ubicación del nivel de inglés, además de pruebas de aptitud, personalidad, inteligencia emocional y potencial de liderazgo. Igualmente, a cada aspirante a cadete se le realizará una prueba psicológica.



El Período Académico 2011 viene con profundos cambios, como resultado de las actualizaciones de los planes de estudio que fueron aprobados por el Consejo Académico de la UMIP, mediante Resolución No. 024-10, los cuales incluyen modificaciones en los contenidos académicos y la metodología de enseñanza, a fin de permitir que todas carreras que se imparten en la UMIP sean homologables con las universidades europeas.



La oferta académica 2011 de la UMIP incluye las siguientes carreras: Licenciatura en Ingeniería Ambiental Marítima, Licenciatura en Ingeniería de Puertos y Canales y la Licenciatura en Administración Marítima e Industrias Auxiliares ; (Nuevas), Licenciatura en Ingeniería en Construcción Naval, Licenciatura en Administración Marítima y Portuaria, Licenciatura en Gestión Logística y Transporte Intermodal, Licenciatura en Biología Marina, Licenciatura en Administración Marítima en Ecoturismo, Licenciatura en Ingeniería Náutica en Navegación y Licenciatura en Ingeniería Náutica en Maquinaria Naval.



La UMIP suscribió un convenio Marco de Cooperación Técnica con la Universidad de Cádiz, España, a través de cual se recomendaron innovaciones en todas las carreras; la creación la nueva Facultad de Ingeniería Civil Marítima y el establecimiento de dos nuevas escuelas: la Escuela de Ingeniería Marítima y la Escuela de Recursos Marinos y Ambientales.



Las carreras ahora tendrán una duración de 4 años más el tiempo que se requiera para la práctica profesional o el embarque, según sea el caso; el sistema de evaluación cambia, se pasa de un régimen cuatrimestral a uno semestral, y se flexibiliza la jornada de educativa diurna, disminuyendo la cantidad de horas que deben permanecer los estudiantes en el campus universitario.

Implementan nueva ruta de cabotaje para el traslado de víveres en Veracruz

Veracruz, Ver.- La Administración Portuaria Integral de Veracruz, reiteró el apoyo a los veracruzanos para salir pronto de la contingencia hidrometeorológica.
El director de APIVER, Juan Ignacio Fernández Carvajal, recordó que se abrió una ruta de cabotaje de emergencia para el traslado de artículos básicos propios de una emergencia de Veracruz a Coatzacoalcos, Dos Bocas y Progreso.

Al rendir un informe sobre las acciones efectuadas, mencionó que el 16 de septiembre a la fecha han realizado mil 300 viajes con carga de basura, movilizando 15 mil 500 toneladas recolectadas. En general participan 350 personas en diferentes rubros

Negó afectaciones en el puerto y contrariamente, aseguró que el movimiento de carga repuntó debido a los cortes en la red carretera.

Mencionó que han suministrado más de 300 toneladas de agua, así como 750 láminas de zinc a grupos vulnerables. Apoyan con 72 vehículos, 19 volteos, 25 camionetas, entre otros.

Dijo que hay confianza en que en diciembre se cierre con un repunte en movimiento de carga arriba del 7 por ciento en relación al 2009, pues el puerto de Veracruz ha dado servicio a algunas embarcaciones que no han podido descargar en Coatzacoalcos y otros recintos.

Ante la contingencia trabajadores de APIVER tuvieron que ponerse a recolectar basura

El director general de la Administración Portuaria Integral de Veracruz (APIVER), Ignacio Fernández Carvajal informó que trabajadores de esa dependencia tuvieron que activarse y se pusieron a recolectar basura para ayudar a que la ciudad regresará a la normalidad lo antes posible.

El funcionario federal dijo que hasta el momento se han recolectado cerca de siete mil toneladas de desechos sobre todo palizada que fue a parar a playa Norte.

De igual manera dijo que se contrataron a 40 personas quienes tenían sus palapas en Punta Gorda para que ellos mismos las reconstruyeran a cambio de una módica cantidad.

Por otro lado informó que en los últimos días se recolectó más de 400 toneladas de víveres con las cuales se elaboró mil despensas grandes para otorgarlas a la población damnificada tras el paso del huracán Karl y la depresión tropical Mathew

En rueda de prensa, que en el centro de acopio se pudo recolectar: arroz, azúcar, frijol, verduras enlatadas, Atún, sardina, pastas, leche, galletas, artículos de higiene personal y de limpieza.

De igual forma, agua embotellada, jugos, energéticos, pañales, medicinas, ropa, cochones inflables; todo aportado por la comunidad portuaria de Veracruz, empresas de Puebla, Distrito Federal, Nuevo León, Instituciones Educativas, entre otras instancias.

En total APIVER donó cerca de 400 toneladas de alimentos y agua para ser repartida entre los damnificados de la zona.

Aumenta importación y exportación de vehículos por el puerto de Altamira

Altamira, Tam.- Con la importación de 30 mil vehículos y mil 500 camiones, el puerto de Altamira se consolida como uno de los principales a nivel nacional, destacando por su situación geográfica.

A través de un comunicado, la gerencia comercial de la Administración Portuaria Integral señaló que el impacto que tiene este municipio es de gran atracción para la inversión privada.

Es por ello que muchas empresas de capital extranjero se sitúan en este puerto, demostrando la confianza que tienen en esta región catalogada como una de las más prósperas de México.

Es así como en el ramo automotriz, en lo que va del año, ingresaron treinta y un mil 500 unidades motrices de todo tipo y de empresas como General Motors.

Una vez que los vehículos son ensamblados en la planta de Coahuila, se exportan hacia Brasil, Argentina, Uruguay, Chile, Perú, Ecuador y Colombia.

Más demandas contra el GUA

Tampico.- Ante las anomalías que aseguran trabajadores del Gremio Unido de Alijadores comete este grupo en contra de sus derechos, tales como adeudarles hasta 18 quincenas de trabajo, prestaciones, fondo de ahorro y otros beneficios señalados por la ley, el presidente de la Junta 39 de Conciliación y Arbitraje Federal en Tampico dio a conocer que las demandas siguen acumulándose y hasta el momento son más de 100.

Así lo dio a conocer Alejandro Peña, titular de esta dependencia, quien señaló que sólo en este año se han recepcionado 39 denuncias y esperan sigan llegando para analizarlas, transferirlas y hacer lo que sea necesario, confiando que puedan quedar resueltas en menos de dos años.

En profunda crisis, se preparan socios del GUA a disolver órganos de gobierno

Tampico, Tamaulipas.- Sumido en la más profunda crisis financiera y laboral, con deudas económicas no cuantificadas y acusaciones al presidente del Consejo de Administración, Ramón Martínez del Angel, de derroche y malversación de recursos materiales y pecuniarios, socios del GUA se aprestan a disolver ese ente de gobierno.

A través de los medios escritos locales, socios de la centenaria cooperativa, “representantes del 20 por ciento de la base”, publicaron la convocatoria con fundamento en la Ley General de Sociedades Cooperativas y en las Bases Constitutivas del órgano sindical, para “acordar la remoción de Ramón Martínez del Ángel, José Cedillo García, Carlos Peña López y Julio Peña López de los cargos de Presidente, Secretario, Tesorero y Vocal del Consejo de Administración”, pues argumentan que faltaron a sus obligaciones.

En la convocatoria, que firman Joaquín Jerez Reyes, Antonio Rodríguez González, José Luis Ramírez Gudiño y Rafael Mendoza Martínez, también se “acordará la remoción de Policarpio Cruz Rivera, Hermilo Arriaga González y Rodolfo Bribiesca Orozco” de sus respectivos cargos en el Consejo de Vigilancia, con lo que también lo disolverán por completo.

“Y de sus respectivos suplentes Juan Adán Segura Yong, Antonio Herrera Almaguer y Damián Guerrero Izaguirre, con fundamento al artículo 36 y demás relativos de la Ley General de Sociedades Cooperativas, y por incumplimiento de lo establecido en la cláusulas 62, 63, 64 y 65 de nuestras Bases Constitutivas”, se precisa en el documento.

La referida convocatoria se fecha para el día 24 de octubre del presente año, a realizar en el salón de actos en el tercer piso del Edificio Alijadores, sito en Isauro Alfaro, número 210, sur, de la zona centro de Tampico.

En el acto, serán nombrados los titulares y suplentes de los consejos de Administración y de Vigilancia “que fungirán en sus cargos durante el periodo comprendido del 24 de octubre de 2010 al 23 de octubre de 2012”, se puntualiza.

De igual forma se prevé la presentación del programa de trabajo del nuevo Consejo de Administración “para el fortalecimiento de las áreas de Administración, Planeación y Desarrollo Económico y Financiero; inclusive (se expondrá) el proyecto de adquisición de maquinaria y equipo, y capacitación y adiestramiento de Recursos Humanos para elevar la competitividad y calidad de nuestros servicios en el marco del Sector Portuario Nacional”, se agrega.

A fin de no dejar “cabos sueltos” que represente una inconformidad posterior, en la convocatoria dirigida a los socios del Gremio Unido de Alijadores, se indica que se hará el nombramiento de un Delegado de la Asamblea “para que ocurra ante notario público de su elección para la protocolización de la acta de la Asamblea General Extraordinaria y su respectiva inscripción ante el Registro Público de Comercio”, se expone en el documento.

Como es del conocimiento de la opinión pública, la disolución de ambos órganos de gobierno de la cooperativa se dará en medio de la más dura crisis económica del GUA, además del descrédito del Presidente del Consejo de Administración del organismo, Ramón Martínez del Angel, pues obreros de base, eventuales y socios lo acusan de malversación de fondos y derroche de bienes, siendo acusado ante la Junta Federal de Conciliación y Arbitraje de Tampico y el Ministerio Público Federal de la ciudad.

Ante todo esto que está en ciernes de ocurrir, nadie sabe dónde está o dónde se oculta el otrora líder de la centenaria cooperativa, Martínez del Ángel, sucesor en el cargo de don Gerardo Gómez Castillo.

Con una inversión de 35 mdp, Apiver tendrá el primer “Centro de Control de Transporte”

Medellín de Bravo, Ver.- Será a principios del año entrante cuando la zona portuaria estrene el primer “Centro de Control de Transporte”, en el cual se invertirán 35 millones de pesos, precisó el director de la Administración Portuaria Integral de Veracruz, Juan Ignacio Fernández Carvajal.
Con este aparato se logrará obtener un mejor control de las mercancías que se manejen en el recinto portuario y para el cual se invirtieron más de 70 millones de pesos.

“Este “Centro de Control de Transporte” será colocado afuera del muelle y forma parte de las obras que se realizan para la ampliación del puerto, ya que así podemos tener un mejor control de lo que entra y de lo que sale, así como de los vehículos que a diario transitan en el recinto portuario”, apuntó.

Juan Ignacio Fernández Carvajal, indicó que va a haber toda una serie de obras, que sin duda pondrán al recinto portuario de Veracruz como el más grande de América Latina, casi comparado a los primeros puertos del mundo.

El funcionario federal fue entrevistado en el arranque del evento que encabezó el titular de la Sedesol, Heriberto Félix Guerra, que dio el banderazo de inicio al programa “Cada quien pinta su casa”.

Calcula API-Quintana Roo que 2010 cerrará con más de mil cruceros recibidos

La Administración Portuaria Integral de Quintana Roo pronosticó que el destino turístico de Cozumel, podría cerrar este año con números por arriba de los mil 30 cruceros recibidos en sus puerto marítimos, lo cual rebasaría por más de 186 cruceros lo registrado en el 2009, así lo dio a conocer el director de esta dependencia en la Isla, Víctor Vivas González. “Desafortunadamente, el año pasado Cozumel cerró con tan sólo 844 cruceros a causa de las dos variantes, recesión económica e influenza, sin embargo, este año también podremos alcanzar y superar en lo mejor de los casos los cruceros que arribaron en el 2008, el cual fue un buen año en cuanto la llegada de los hoteles flotantes”, expresó.

En este sentido, el titular de la Administradora de Puertos de Cozumel, reiteró que durante el presente año se ha notado un ligero aumento en cuestión del número de cruceros que han tenido presencia en la ínsula en comparación con años anteriores.

“En el presente año nos encontramos a punto de alcanzar los mil hoteles flotantes recibidos en los puertos de la isla, donde tomando en cuenta que aún faltan dos meses para cerrar el año, se puede pronosticar que los registros pudieran cerrar en más de mil 30 unidades”, manifestó.

Para finalizar, Vivas González dijo que durante los meses restantes del año, ya se tiene un número considerable de reservaciones de puerto, en el que se puede resaltar que para el último mes del año, diciembre, habrán domingos que contarán con mayor actividad de cruceros en comparación con los anteriores meses.

PLC será anfitrión de la 1ra. Convención Hemisférica Sobre Logística y Competitividad Portuaria

El Puerto de Lázaro Cárdenas será anfitrión de la 1ra. Convención Hemisférica Sobre Logística y Competitividad Portuaria, donde habrán de participar alrededor de 200 delegados procedentes de más de 34 países, informó el Gerente de Comercialización de la Administración Portuaria Integral local, Julián Pérez Rodríguez.

Dicha convención habrá de realizarse del 3 al 5 de noviembre próximo, en la ciudad de Ixtapa-Zihuatanejo; aquí resaltan temas donde los puertos, como el de España, compartirán sus experiencias en rubros como la innovación y la competitividad.

El Gerente de Comercialización del Apilac dijo que “se espera recibir miembros distinguidos de la comunidad portuaria nacional e internacional”, donde el puerto de Lázaro Cárdenas será un “escaparate” a nivel mundial en el tema logístico.

Referente al puerto michoacano, señaló que se expondrá en ésta Convención las ventajas competitivas con las que se cuentan, “vamos enfocados a resaltar lo que el puerto de Lázaro Cárdenas puede ofrecer al comercio”; cabe señalar que este puerto es un eslabón importante entre el mercado norteamericano y el asiático, por su ubicación estratégica.

Explicó que los números estadísticos del puerto de Lázaro Cárdenas a nivel mundial han destacado y esto ha puesto al puerto en la mira en el tema marítimo portuario, lo que le valió ser sede de ésta primera convención.

Lázaro Cárdenas del 2005 al 2008 pasó de estar colocado en el lugar 279, de 365 puertos, al 154, según el World Container Trafic League Rank.

Pérez Rodríguez adelantó que éste 2010 se cerrará con un movimiento aproximado total de 750 mil contenedores, cuando se habían estimado serían cerca de 630 mil; este comportamiento de incremento se espera tener para el 2011, dicho crecimiento se prevé sea de 2 dígitos.

En relación a la convención de la cual PLC será anfitrión, concluyó diciendo el día final del evento se realizaría una visita guiada por las instalaciones portuarias de Lázaro Cárdenas.

Ampliarán muelle siete de recinto portuario

Veracruz, Ver.- El director de la Administración Portuaria Integral, Juan Ignacio Fernández Carbajal anunció que se invertirán 70 millones de pesos para la ampliación del muelle siete del puerto de Veracruz.

Esta obra permitirá contar con un muelle de 320 metros de eslora, es decir, podrán recibirse embarcaciones muchos más largas.

“Es el siete sur y seis norte se está ampliando en 400 metros con el objeto de poder recibir barcos de mayor eslora, está adelantado en 70 por ciento, esperemos que esté terminado a más tardar en febrero de este año”.

Actualmente el calado de los muelles del puerto permiten recibir embarcaciones de hasta 40 pies “el problema es que la eslora no nos daba y va a quedar ahora en 320 metros para poder recibir embarcaciones más largas”.

Po otra parte, Juan Ignacio Fernández Carbajal negó que API tenga que ver con el presunto relleno que se está haciendo a la laguna San Julián para el desarrollo del puerto seco misma que está cargo de la cesionaria Corporación Integral de Comercio Exterior.

Puerto LC, presente en Expo Shanghai

LÁZARO CÁRDENAS, Mich., 19 de octubre de 2010.- Como parte de las actividades de promoción del Puerto Lázaro Cárdenas una delegación de negocios conformada por la Administración Portuaria Integral de Lázaro Cárdenas y la Secretaría de Desarrollo Económico del Gobierno de Michoacán, realizó una gira de negocios por el país asiático del 12 al 16 de octubre.

La gira inició con la participación del Puerto Lázaro Cárdenas en la Expo Shanghái Universal en la inauguración de la semana del estado de Michoacán en el pabellón de México donde la delegación fue recibida por la directora del pabellón de México, Ana García y Chen Daoxi, Vicedirector del Buró del Puerto de Shanghái.

“Será una semana provechosa para que exista más México en China y viceversa, consolidándose como dos grandes aliados”, expresó Ana García; por su parte del Sr. Chen Daoxi manifestó que espera que los encuentros de negocios que se van a mantener en estos días representen el “Inicio en las relaciones entre el Puerto de Shanghái y el Puerto Lázaro Cárdenas”.

El Puerto Lázaro Cárdenas sostuvo su primer reunión de negocios con la Asociación Nacional de Agencias Navieras en China con el objetivo principal de promover a Lázaro Cárdenas como puerto de enlace para el intercambio comercial de mercancías provenientes del continente asiático con destino u origen en China hacia o desde México y Estados Unidos, ofreciendo ventajas de infraestructura para este sector en la atención a embarcaciones de última generación y conectividad a los principales centros industriales y consumo a través del ferrocarril y el autotransporte.

Posterior a ello, la delegación se reunió con la Asociación Nacional de Puertos Chinos y el 14 de octubre el Puerto Lázaro Cárdenas visitó a sus homólogos en Ningbo para intercambiar experiencias de éxito para la adopción de mejores prácticas en cuestión de planeación, operación y administración del Puerto Lázaro Cárdenas; cabe señalar que en junio de 2002 Lázaro Cárdenas suscribió un Acuerdo de amistad y cooperación con el puerto de Ningbo y está visita servirá para dar seguimiento a los avances de 2002 a la fecha del intercambio comercial entre
ambos puertos.

La gira concluyó con una visita a Hong Kong para sostener dos encuentros de negocios, el primero con el Consejo para el Desarrollo del Comercio de Hong Kong y el segundo con las autoridades portuarias de dicho lugar para finalizar con un recorrido a las instalaciones del puerto.

Actualmente el intercambio comercial entre el Puerto Lázaro Cárdenas y China, tan sólo en carga contenerizada representa el 85% en carga de importación y el 66% en exportación.
De esta manera el Puerto Lázaro Cárdenas con especial atención al mercado global en el que está inmerso, sostiene nutridos encuentros de promoción y negocios para posicionarnos y efrendarnos como un referente de clase mundial para el intercambio comercial entre China y México.

Fraude en la aduana de Veracruz

La comunicación proviene de Francisco Javier Garzón, el nuevo Consejero Económico y Comercial de la Embajada de España en México. Es una búsqueda de información sobre “posibles irregularidades en el pago del IVA en la Aduana de Veracruz”.

Víctimas de estas irregularidades podrían ser, por supuesto, compañías importadoras establecidas en aquella nación. Pero la alerta, difundida originalmente por la delegación de la Unión Europea en México, se extiende a empresas de todo el viejo continente a las que habrían defraudado agentes aduanales basados en el puerto jarocho.

Dice la comunicación, en partes esenciales: “Se han presentado casos en que empresas europeas han pagado sus facturas de IVA a través de agentes aduanales y al parecer éstos les han falsificado los documentos y pagado un monto menor de IVA. De esa manera, se le ha generado una “deuda” fiscal a la empresa con el SAT. Por tener sólo las copias de los recibos de pago originales, la empresa no está en posibilidad de darse cuenta que la diferencia entre la factura original y la falsa no fue depositada en las cuentas del SAT.

“Es posible que este fenómeno exista ya desde hace varios años y, por lo tanto, los montos pueden ser importantes. El riesgo inminente para las empresas (afectadas pero no necesariamente enteradas) es que puedan ser sujetas a una revisión por parte del SAT y en ese caso se vean forzadas a pagar su ‘adeudo’, el cual puede llegar a representar sumas significativas”.

Esta alerta no alude a las víctimas de los fraudes ni a los responsables de los mismos. Más bien, es una advertencia para las empresas europeas, sobre un problema que puede llegar a tener consecuencias económicas muy serias si no se detecta a tiempo. Para las afectadas, ya se busca una “solución conjunta” a través de las legaciones europeas, que -eso sí- se alistan para manejar una crisis que puede superar los cálculos formulados por las autoridades mexicanas.

¿Cuántas empresas hay afectadas? ¿Cuántas más acudirán a reportar su caso a sus embajadas? A saber. En Veracruz está la primera aduana marítima y la tercera, a nivel nacional, tan sólo después de Nuevo Laredo y Tijuana. El 75% de las unidades automotrices que se importan entra por este puerto, lo mismo que 30% de la carga a granel, 47% de los productos agrícolas y 38% de los contenedores que llegan a México. Algunas de las empresas que utilizan el puerto de Veracruz como canal de distribución para la exportación son: Volks­wagen, Mabe de México, Procter and Gamble, Daimler Crhysler de México, Pemex, Cervecería Modelo y Tamsa, entre muchas otras.

Asimismo, el puerto de Veracruz cuenta con 10 almacenes operados por particulares, los llamados “recintos fiscalizados”. Éstos son: CICE, CVT, OPG, TCE, Alsur, TMM, Golmex, Astro, Vopak e Icave, este último maneja 75% de las mercancías que entran al puerto de Veracruz.

La información disponible sólo permite establecer que la mayoría ha solicitado confidencialidad a las autoridades mexicanas. En el caso de los agentes aduanales defraudadores tampoco se conoce más información, salvo que hay una investigación en curso, en torno de que varios de ellos detentan patentes sin contar con título universitario.

En cualquier caso, los interesados deberán revisar sus estados fiscales, desde el 2005. Si hubiera discrepancias significativas se les recomienda solicitar copias certificadas de las facturas que tenga el SAT en sus archivos y mientras tanto les invita a considerar la opción de pagar el IVA de sus mercancías directamente al fisco mexicano, lo que podrían hacer directamente en la ventanilla de una sucursal de Banamex.

Todavía antier, en algunos periódicos de provincia, apareció un desplegado a plana entera del gobierno federal, mediante el cual se ofrece una recompensa “de hasta 10 millones de pesos” a quien proporcione información fidedigna que permita la localización del administrador general de la Aduana Marítima de Veracruz, Francisco Serrano Aramoni, quien fue secuestrado por un comando armado hace 15 meses. De tez morena, barba de candado, cejas pobladas, complexión media, 1.82 metros de estatura, el funcionario fue privado de su libertad la noche del 1 de junio del 2009. Aproximadamente a las 9:42 de la noche de ese lunes sufrió un percance después de haber salido de su oficina, en el recinto portuario, a bordo de una camioneta Jeep Liberty color plata, modelo 2003, matrícula XAY 1447.

Los puertos de Campeche tiene las tarifas más bajas en los sistemas costa afuera y la proyección para el 2011 está en función a la autorización de una reestructuración tarifaria

Se requieren cerca de mil millones de pesos para las tres magnas obras portuarias que son fundamentales para la administración que encabeza Fernando Ortega Bernés, porque son necesarias para el desarrollo del estado porque están certificados por organismos internacionales como puertos seguros, aseguró Fernando Sadek Abad, director general de la Administración Portuaria Integral, quien advirtió que Campeche no puede seguirse ateniendo a la actividad petrolera.
En entrevista exclusiva, explicó que los puertos de Campeche tiene las tarifas más bajas en los sistemas costa afuera y la proyección para el 2011 está en función a la autorización de una reestructuración tarifaria, lo cual daría oportunidad de tener recursos pues en este sistema se tienen tres concesiones, el Puerto de Cayo Arcas y las terminales de Yuum-Kaab y Tankum-Tha, a los que se conectan alrededor de 300 plataformas que hay frente al Golfo de Campeche, y los barcos que llegan a cargar para exportar petróleo al mundo, pagan una tarifa.
Indicó que las obras prioritarias son la ampliación de los Puertos de Seybaplaya y de Isla del Carmen, y la modernización integral, con un cambio total de imagen, del de Lerma, para las que se requieren cerca de mil millones de pesos, de los cuales, 500 serían recursos propios de la API, para las primeras etapas, y se está negociando que la federación aporte una cantidad igual para las segundas partes "es lo que estamos negociando, el gobernador está gestionando y ahí estamos tratando de concientizarlos de que es importante para el desarrollo del estado"
Manifestó que a largo plazo el puerto más importante será el de Seybaplaya, porque el estado no puede depender de una sola actividad ni atenerse nada más a la logística petrolera, de tal manera que con esa visión, se tiene que ir diversificando la economía, con actividades como la comercial y turística, y para consolidarla "se requiere establecer ya, rutas comerciales, vía marítima, con nuestros puertos"
Recalcó que para ello es necesaria la profundidad, y esa es la debilidad que tienen los puertos campechanos, por lo que, la ampliación del puerto de Seybaplaya requiere salir 5.5 kilómetros, para que puedan entrar las embarcaciones de mayor calado, como son las comerciales y las turísticas, por lo que tendrá, en su primera etapa, 3.5 kilómetros de viaducto de 12 metros de ancho, con una plataforma de 40 mil metros de terreno, con 400 metros lineales de áreas de muelles de atraque "ya llevamos un avance de 1.3 kilómetros y una inversión de alrededor de 150 millones de pesos"
Fernando Sadek subrayó que en Carmen es difícil buscar profundidad porque lo que se haga se azolva por estar en la Laguna de Términos y no lo necesita porque los barcos petroleros son grandes pero no de gran calado, pero está saturado y ya no hay espacio para atender la actividad petrolera, por lo que se ampliará 7 hectáreas, con 800 metros lineales de muelles, a fin de poder cubrir la demanda de atraque y dar respuesta a la demanda de espacios de servicio.
Significó que en el puerto de Lerma ya tienen una inversión inicial de 6 millones y para el próximo año se tiene proyectado terminar la primera etapa, con alrededor de 16 millones mas.
El funcionario indicó que el presupuesto general que este año ejerció la API, fue de alrededor de 265 millones, de los cuales 175 millones fue para construcción y mantenimiento de la infraestructura portuaria, pero también tienen a su cargo la vigilancia de los principales puertos, y se tiene que mantener el status que exige el código de seguridad, porque son puertos con certificación internacional a fin de que puedan seguir atracando barcos de EE. UU. Y que los barcos estatales puedan ir a Estados Unidos.
Finalmente apuntó que la intención es que, a través de los puertos, puedan llevar y traer productos, y Seybaplaya tiene muchas ventajas, y una es su conectividad, porque está pegado a la carretera federal 180, tiene la autopista, y a 30 kilómetros tiene la estación de ferrocarril y adelantó "estamos haciendo un estudio, junto con la Secretaria de Desarrollo Industrial y Comercial, para ver si es factible acercar más las vías férreas, el servicio ferroviario, hacia el puerto".-Aurora Sansores

Riqueza en la Península

En momentos en que la explotación petrolera en la Sonda de Campeche ha entrado en declive, nuevas investigaciones de Pemex ratifican el potencial petrolero de la Península de Yucatán y su zona marina adyacente.

De acuerdo con un estudio, en el área estudiada habría yacimientos petrolíferos prospectivos calculados en 300 millones de barriles de petróleo crudo equivalente, pero hay evidencias de que la riqueza puede ser mucho mayor, por la cercanía con pozos "excepcionalmente ricos" en Guatemala y Belice.

Los estados de la Península pertenecen a la provincia petrolera Plataforma de Yucatán. En las nuevas investigaciones se hicieron perforaciones exploratorias en Campeche y Yucatán.

A pesar de la riqueza ratificada, la Plataforma Yucatán no figura entre las prioridades a corto plazo de la empresa.

"Arctic Sunrise" de Greenpeace atracará en Veracruz

La Administración Portuaria Integral de Veracruz, informó sobre el arribo al puerto jarocho del rompehielos de Greenpeace, “Arctic Sunrise”, el cual atracará en Veracruz como parte de su travesía a la cumbre mundial ecológica que se celebrará en Cancún en diciembre próximo. .De acuerdo con el Director General de Apiver, Juan Ignacio Fernández Carbajal, el "Arctic Sunrise" antes de ser adquirido por Greenpeace era un pesquero de ballenas, pero ahora es utilizado para defensa de los mares, denuncia de pesca ilegal y campañas de promoción a favor medio ambiente.

Agregó que tuvo una reunión con personal de avanza de Greenpeace quienes le comunicaron que el barco llegará a Veracruz el 2 de noviembre y atracará en el Muelle Turístico donde permanecerá varios días promoviendo acciones a favor de la ecología.

EU renews push for ship emissions caps

The European Union has reinforced its push for greenhouse-gas (GHG) emissions caps on shipping, urging the upcoming UN climate convention (UNFCCC) conference in Cancun to act in the absence of such action from the International Maritime Organization (IMO). The EU has already signalled an intention to act unilaterally and impose GHG caps on shipping in the region if action is not taken by either IMO or the UNFCCC.

A European Council meeting of environment ministers formulating EU positions for Cancun concluded last week the UN conference “should urge ICAO [the International Civil Aviation Organisation] and IMO to develop without delay a global policy [emissions reduction] framework in a manner that ensures a level playing field and that does not lead to competitive distortions or carbon leakage.” The ministers also reaffirmed the EU’s call for global GHG emissions reduction targets for international aviation and maritime transport, consistent with the plus-2°C global warming limit.

The IMO’s Marine Environment Protection Committee (MEPC) considered emissions reduction options earlier this month but did not reach final agreement on technical and operational measures and convened a working group to give further consideration to proposed market-based measures.

While welcoming the recent progress made on aviation emissions by ICAO, IMO’s sister UN agency for air transport, as an important first step in stabilising aircraft emissions, the Council said only that it “looks forward” to progress in the inter-sessional working group meeting of the IMO in the spring of 2011.”

In reference to a political stalemate in IMO over conflicting global equity principles between it and the UNFCCC, the EU Council said any policy frameworks drawn up for aviation and shipping “should be in accordance with the principles and customary practices of ICAO and IMO, taking into account the principles and provisions of the UNFCCC in the use of potential revenues.”

This suggests that it sees the way to resolve the dispute, essentially between developed and developing countries, is to apply emissions restrictions equally to ships of all nations but to distribute any tax or permit revenues raised in favour of developing countries.

Drydocks World wins $100m Tidewater contract

Under the terms of the contract, Tidewater Marine has the option to place orders for four more PSV units to be built by DDW-Nanindah on the successful completion of the first four vessels

Dubai: Drydocks World said it has won a $100.4 million contract to build four Platform Supply Vessels (PSV), with option for four more units, for Tidewater Marine, a wholly-owned subsidiary of Tidewater, the world’s largest provider of marine support services for the offshore energy industry.

The vessels will be built at DDW-Nanindah shipyard at Batam in Indonesia and the first unit is targetted for delivery in 18 months, followed by the rest every two months.

Each PSV will be constructed to Rolls Royce Marine’s design, and powered by Diesel Electric Propulsion. It will be 81.55 metres long, weigh 3,200 tons and will be equipped with a cargo deck measuring 670 square metres.

Khamis Juma Buamim, Chairman, Drydocks World & Maritime World, said: “We are confident and despite the global downturn we are modifying and managing change with clear vision, we do believe that our new horizon will ensure and enhance the sustainability cycle of our business. This contract is recognition of Drydocks World’s capabilities as a resilient ship builder and the international maritime industry’s vote of confidence in our expertise.”

Under the terms of the contract, Tidewater Marine has the option to place orders for four more PSV units to be built by DDW-Nanindah on the successful completion of the first four vessels.

Some of the recent vessel deliveries that have highlighted the heavyweight construction and engineering capability of Drydocks World yards include Windermere, a subsea operation vessel and OSA Sampson and OSA Goliath, two of the world’s largest offshore construction vessels for Coastline Maritime. CSS Derwent, a compact semi-submersible subsea operation vessel for Hallin Marine is under construction.

Nanindah is one of the busiest ship-building yards in Asia and is widely recognised for its capabilities as an integrated maritime solutions provider in the Southeast Asia region
DDW also has three other ship yards, DDW-Singapore, DDW-Graha and DDW-Pertama in SEA, in addition to the Dubai Shipyard. The facility in Singapore is a repair and new building yard, the shipyard at Graha is a dedicated rig building unit and the one at Pertama is a mixed-use yard.

UK. 10 foreign ships under detention in the UK during September

The Maritime & Coastguard Agency (MCA) announced today that 10 foreign flagged ships were under detention in UK ports during September 2010 after failing Port State Control ( PSC) inspection.

Latest monthly figures show that there were 9 new detentions of foreign flagged ships in UK ports during September 2010 and 1 vessel under detention from previous months. The overall rate of detentions compared with inspections carried out over the last twelve months was 3.5% this is slightly down from August’s twelve month rate.

During the month of September178 Port State Control inspections were carried out in the UK. A total of 65 vessels had no deficiencies raised against them, 81 had between one and five deficiencies, 17 had between six and ten deficiencies, 11 had between eleven and twenty deficiencies and 4 vessels had more than twenty deficiencies.

Out of the detained vessels 8 were registered with flag states listed on the Paris MOU white list, 1 was registered with a flag state on the grey list none were registered with flag states on the black list and 1 was unregistered.

1. In response to one of the recommendations of Lord Donaldson's Inquiry into the prevention of pollution from merchant shipping and in compliance with the EU Directive on Port State Control (95/21/EC as amended), the Maritime and Coastguard agency (MCA) publishes full details of the foreign flagged vessels detained in UK ports each month.

2. Inspections of foreign flagged ships in UK ports are undertaken by surveyors from the MCA. Where a ship is found to be deficient or lacks the required documentation, MCA surveyors can take a range of actions leading to detention in serious cases. The UK is part of a regional agreement on port state control known as the Paris Memorandum of Understanding on Port State Control (Paris MOU) and information on all ships that are inspected is held centrally in an electronic database known as SIReNaC. This allows the ships of flags with poor detention records to be targeted for future inspection.

3. Detained ships have to satisfy surveyors that remedial work has been carried out before they are allowed to leave port.

4. When applicable the list includes those passenger craft prevented from operating under the provisions of the EU Directive on Mandatory Surveys for the safe operation of regular Ro-Ro ferry and high speed passenger craft services (1999/35/EU).

A 1,925 GT General Cargo Vessel was detained in Seaham because deficiencies that had been identified during an inspection in July 2010 had not been cleared. The classification society had raised numerous class conditions one of which was that the vessel did not have a cargo securing manual on board. In addition there were crew certificates without flag state endorsements and the voyage plan was not as required.

The vessel was detained in Tilbury for 10 days because it was suspected that oil had been discharged into the River Thames from the port fuel tank and the starboard side discharge pipe. A Major non conformity was identified in respect of the maintenance of the ship and equipment which was not according to the SMS.

Other deficiencies found included: the hand rails in the main engine room were broken; the oil tank sight glasses were gagged open and there were fuel/oil leaks from the main engine camshaft.

Other deficiencies found were insufficient provisions for the intended voyage and medicines were out of date. In addition the following items were found to be missing:

distress flares; line throwing appliances; lifebuoys; life jackets with lights; immersion suits; satellite EPIRB (Emergency Positioning Indicating Radio Beacon); fire extinguishers and the fire hose nozzle.

World Body Reacts To Shipping Act Aimed At Regulating Freight Rates

US – Following their initial comments last month on the ‘Shipping Act 2010’ H.R.6167, the World Shipping Council (WSC), whose members operate around 90% of liner shipping capacity including all the major container and bulk freight and tanker carriers, has come out heavily against the proposed changes which the Bill, if passed, would make with regard to the way that the international liner shipping industry is regulated in U.S. foreign trades.

The WSC say that much attention has been paid to the fact that the bill proposes elimination of the limited antitrust immunity currently available for rate discussion agreements filed with the Federal Maritime Commission (FMC). It is the ocean carriers’ expectation that the repeal of rate discussion authority would lead to greater rate volatility and less predictable and less stable markets, which would not be beneficial to U.S. commerce.

In a somewhat ominous tone the WSC statement says: ‘If the U.S. Congress were to consider this change in the law, the group (WSC) states that the U.S. Congress should carefully consider and be comfortable with the market effects that would result.’ The statement continues to point out that H.R. 6167’s proposed changes are not limited to rate discussion agreements, however, it contains many other provisions that the WSC believe would be detrimental to trade.

The Council asserts that passing the Bill would create an ocean transportation system that would make U.S. trades less efficient and more costly for carriers, resulting in less choice, less capacity, lower service quality, and higher costs for U.S. exporters and importers whilst giving more regulatory powers to the Federal Maritime Commission (FMC). The FMC would effectively have direct control over cargo carriers in terms of their relationship with customers including commercial negotiations about space availability, new equipment regulations for ship owners with more burdensome and costly reporting requirements.

The WSC state that it does not expect this Congress to enact H.R. 6167 during its remaining days of session, but determined that the serious adverse consequences of the proposal warranted a statement and analysis given that proponents of the Bill were arguing that the proposed changes resemble the approach taken by the European Union towards such agreements and that it would not significantly affect carriers’ operating agreements and would allow those agreements to remain in place.

Texas Southern Launches Maritime Degree Program — A First for an HBCU

Schineatha Rodriguez had worked in the maritime industry for more than six years. She was responsible for loading the vessels that exported items around the world to distant places in Latin America and Europe.

“It was a dynamic experience,” she says. “I learned that there were so many roles and responsibilities in making a ship move to other parts of the world.”

But then the 53-year-old Houston resident was laid off from her job and decided she should return to college and earn the college degree that she started many years ago.

“I knew that I wanted to attend an HBCU because I believed it would support me better than any other environment,” says Rodriguez, who began researching possible majors that sparked her interest.

And then she came across an unusual announcement last spring.

Texas Southern University planned to launch a new Bachelor of Science degree in Maritime Transportation Management and Security — the first undergraduate degree program of its kind at a HBCU.

“I was so excited,” says Rodriguez, who received a full scholarship in the amount of $18,000 per year to participate in the program. “I loved the industry and was pleased to see this new program offered.”

TSU established the program in collaboration with $2 million in start-up funds from the Port of Houston Authority — one of the nation’s largest ports — to respond to the dearth of minorities in managerial positions and an aging maritime industry work force that will need to be replaced over the next decade.

Nationwide, port officials say the maritime work force is increasingly aging (with an average age of about 45) and there is a need to develop a pipeline for younger workers. Minorities in managerial positions nationwide account for less than 15 percent of the overall work force, officials say.

The initial grant of $2 million will fund the program for the first five years, says Ursurla A. Williams, the program coordinator at TSU. University officials are also soliciting additional funds through the state Legislature and private foundations.

Port of Houston Authority officials say there will likely be a demand in the future for careers in freight logistics, shipping management and maritime transportation planning.

“Recently, there has been a global call for an infusion of a prepared work force into the maritime industry," says James T. Edmonds, the chairman of the Port of Houston. "This partnership integrates the resources of two dynamic Houston institutions committed to advancing education, commerce and improving quality of life. The success of this program will reap benefits that will be felt locally, nationally and around the world."

The response to the new major has been well-received on campus. The inaugural class has 33 students — 24 of whom receive either full or partial scholarships. Last spring, TSU officials targeted area high schools and community colleges to generate interest in the program.

“There has been great interest among our students,” says Williams, who believes that other HBCUs headquartered in cities with major ports might consider replicating the program on their campuses. “The program has been well-received.”

TSU maritime majors must complete 121 credits and take a variety of courses, including Introduction to Maritime, Maritime History and Maritime Law. Many of the courses are taught by vessel captains and other industry professionals.

Rodriguez is enrolled in four classes and will earn her degree in two years.

“I know that I want to return to the maritime industry but this time I will have a college degree in hand and so many more doors will be open for me,” she says. “Before I was laid off, I found out that if you are working and you don’t have the college degree, you don’t get the opportunity for promotion. Some of the doors are closed.”

Singapore to Establish a Maritime Institute

MANILA, Philippines – Singapore is planning to establish a Maritime Institute (MI) that would adopt a holistic approach to maritime education.

This was disclosed by Teo Chee Hean, Singapore's Deputy Prime Minister and Minister for Defense during the 25th anniversary of the Singapore Shipping Association's 25th anniversary.

Hean said the maritime institute is expected to drive research and development (R&D) in key areas such as green shipping, maritime logistics and operations, as well as marine and offshore engineering.

It will also attract renowned academics and researchers to Singapore, and groom the next generation of local maritime talent.

Hean said the Singapore MI will also coordinate the strategic activities of various maritime institutes and centers at local institutes of higher learning. (EHL)

Who’s Who Legal: Have the recent worldwide economic difficulties affected the shipping industry? Which areas remain particularly busy?

Frazer Hunt: Like all industry sectors, the crisis has led to corporate insolvencies, with companies ceasing trading or restructuring, particularly in sectors involving importers and exporters. Relatively speaking, however, Australia has remained largely untouched by the economic crisis and continues to import goods at similar or greater levels than before commencement of the downturn. Vehicle carriers and container ships were the worst affected by the GFC, but are picking up again. Charter party negotiation and disputes have remained steady, albeit that freight rates and hire have fluctuated in certain areas.

John Kimball: The crisis affected all sectors of the shipping industry; the liner business and dry bulk may have been the hardest hit. The good news is that only a small number of ship-owning companies did not survive the crisis and, at least in the United States, we had only a few bankruptcies of companies in the shipping industry.

Helen Noble: The global economic crisis has had a significant impact on the shipping industry in Ireland. The volume of throughput at our ports for 2009 decreased significantly, by 22 per cent. There was less demand for imported goods due to lack of consumer confidence. The crisis has also been a challenge for Irish exporters; whilst the decline in exports has not been as sharp as the decline in imports, various sectors of the industry have been hit substantially. Bulk volumes fell to levels experienced in 1995, and the lo-lo and ro-ro markets are back to 2003 and 2005 volumes. Break bulk cargo volumes also fell dramatically, due mainly to a fall in the construction industry. There are, however, some signs of recovery in the sector for the fourth quarter of 2009 and the first quarter of 2010.

Rhys Clift: The economic crisis will have had widespread effects. The substantial ordering and delivery of new buildings will probably continue to have an impact, possibly serious. In the UK – indeed, in the West at large – there is much reporting of domestic debt reduction, the paying-off of credit card debts and cutting back of discretionary spending. One assumes that this would have led to, and may still ground, a significant reduction in demand for the transport of consumer goods from the Far East – whether East to the USA’s West coast or West to Europe, presumably impacting the container trade. More recently there has been a surge – or a resurge – in prices of commodities such as minerals and ores. One assumes this should benefit dry bulk shipping, although would this be counterbalanced by the availability of new tonnage?

Who’s Who Legal: How has this changed the nature and amount of work for shipping and maritime lawyers?

John Kimball: Transactional work has been affected due to a credit crunch and diminished access to capital markets. We have seen an increase in charter party disputes. A change in the law concerning Rule B cases affected a number of maritime law firms.

Helen Noble: The recession in Ireland has given rise to an increase in general insolvency work for the firm as a whole: transactional work, specifically, has been affected. We saw a rapid decline in new shipping business establishing in Ireland. We have, however, seen an increase in shipping and transport-related disputes and increased interest in pursuing protective measures, such as ship arrest.

Frazer Hunt: Apart from an increase in general corporate and insolvency work for the firm, we have noticed a marked increase in ship arrests and freight forwarders (NVOCCS) exercising liens over cargoes in an effort to obtain advantage over other creditors. Routine cargo and liability work remains steady.

Rhys Clift: When money is tight, people fight. The economic crisis has resulted in the usual shift; transactional activity is down and disputes are broadly up, whether on contracts for the carriage of goods, policies of insurance or the purchase and construction of ships. If the figures were readily to hand, I would guess that we would see a strong correlation between periods of depressed economic activity on the one hand and a surge in litigation or arbitration on the other; for example now as in the 1930s, during the OPEC crisis and during the Far East problems of 1998.

Who’s Who Legal: How has the relationship changed between client and law firm? Have there been developments in the role counsel play, billing rates or other areas?

Frazer Hunt: The relationship between our firm and the transport and trade clients has remained consistent, with a modest increase in fees this financial year which were largely frozen last year. Some firms have experienced slower paying of bills and staff movements have picked up recently, due to the perceived upturn.

Helen Noble: The biggest impact of the economic crisis on the relationship between client and law firm is in the area of fees. Clients have consistently been looking for reduced fee arrangements or alternative billing arrangements and as a firm we have had to adapt accordingly.

John Kimball: We have seen more requests for, and interest in, alternative billing arrangements than ever before. To be successful in this difficult economic climate, law firms and clients need to work closely together to create fee arrangements which serve both of their needs. We have definitely seen more pressure on billing rates and have made adjustments in our staffing and hiring requirements as a result.

Rhys Clift: The law is not isolated from the general economy. In times of financial difficulty clients look to all outgoings, including fees. Alternative charging methods attract attention. However the focus is not exclusively on price or rate, but rather on value for money. There is a realisation that an apparently costly individual, team or firm, judged by an hourly rate alone, may be excellent value for money. They may be able to produce high-quality results quickly and efficiently, resulting not only in an overall saving on fees but a significantly better overall financial outcome.

At a time when it is necessary to control costs, E-Disclosure poses a threat to the economic management of litigation and arbitration and imposes significant burden on clients in compliance - quite apart from the new risks created by the ease of creating, storing and sending messages, and informality creeping into business exchanges. Lawyers and clients need to co-operate closely to manage the difficulties of E-Disclosure

Who’s Who Legal: What new trends are you seeing in your own jurisdiction, either in terms of domestic regulation, the related legal market or in the industry itself?

Helen Noble: The most significant development in Ireland is the much-publicised establishment of the National Asset Management Agency (NAMA), established by the Department of Finance in 2009 with a view to restoring stability to the Irish banking system. NAMA will purchase land and development loans as well as associated commercial loans with a nominal value of approximately €80 billion from the relevant financial institutions, for an estimated purchase price of €54 million, for the purposes of freeing up the institution’s capital from long-term loans. NAMA will then seek to maximise the value of, and recover, the loans.

It is recognised that Ireland’s recovery from recession will be export-led, and therefore focus is on how to drive up export volumes by development of the transport network and port infrastructure.

Frazer Hunt: Australia is reforming personal property securities, due to perceived limitations for the use of personal property as security, as a result of complexities and gaps in the arrangements for registering security interests. The Commonwealth government is in the process of establishing a national system for the registration of personal property securities which will be implemented by Commonwealth legislation. It is anticipated that some of the reforms will overlap with the Admiralty Jurisdiction of the Australian Courts.

John Kimball: The Deepwater Horizon disaster has led to potentially very significant legislative changes in the United States, which may affect not only the legal regime governing drilling rigs and oil spills but the regulatory regime for shipping in the US generally. We have also seen significant activity with increased sanctions against Iran and certain Al Qaeda persons believed to be involved in piracy in Somalia. It has been a period of very considerable legislative and regulatory activity. For ship-owners and their insurers, these developments only underline the continued need to be actively involved with US government officials in helping to develop new laws and regulations. It is very important for shipping groups to have as much input as possible.

Rhys Clift: We are seeing the impact here of US laws in relation to piracy (efforts to restrict payment of ransom) and sanctions, particularly against Iran. Insurers doing business in England are alert to regulation abroad – especially that emanating from the USA, given the importance of the USA as a market and the extent of US involvement in the capitalisation of insurance and reinsurance. There has been similar regulatory change in the EU. As for shipping, hardly a day goes by when the subject of climate change does not feature in the specialist press; progressive and radical regulatory change seems inevitable. Energy sources, transportation, use and effect on the environment; these are, along with security of supply and the availability of clean water, the issues of this generation. As to the legal market, ADR continues to grow, albeit not as quickly as some might have predicted following the major reforms to civil justice in 1999. ADR, and mediation in particular, has become a fact of life in commercial litigation. It is now regarded as an integral part of litigation by some of the most senior judiciary (rather than some external alternative); but is making progress more slowly where disputes are subject to arbitration (much-used in maritime matters). The implementation of the EU Mediation Directive in 2011 (for cross-border disputes) will give added impetus to the spread of knowledge and use of ADR within the EU and beyond, hand in glove with the need to manage the cost of resolving disputes.
